TSR Maxeda Benelux BV – Website Sales

1. Scope of application

1.1 Validity

These terms and conditions apply to all agreements concluded via www.mrhenrys.eu between the customer and TSR Maxeda Benelux BV (Gramsbergerweg 66, 7772 PB Hardenberg, Chamber of Commerce number 59961538). They form an integral part of the agreement, unless otherwise agreed in writing.

1.2 Priority

These terms and conditions take precedence over those of the customer or third parties, even if TSR does not expressly object to them.

1.3 Acceptance

By placing an order, the customer accepts these conditions.

1.4 Nullity

If any provision is invalid, the remaining provisions remain valid. TSR will replace the invalid provision with a valid, comparable provision.

2. Prices

2.1 Price indication

All prices are in euros, including VAT and excise duties. The price on the order date applies.

2.2 Delivery costs

Delivery costs will be communicated in advance and will be charged to the customer, except for subsequent shipments at TSR's expense.

2.3 Price changes

TSR may correct typographical errors and adjust prices due to objective circumstances beyond its control, such as changes in VAT, excise duties or raw material prices.

3. Orders

3.1 Establishment

An agreement is concluded as soon as the customer sends the order electronically.

3.2 Age

TSR only supplies to adults.

4. Retention of title

The goods remain the property of TSR (or partners) until full payment has been made, including any shipping costs.

5. Payment

5.1 Payment method

Payment is made directly and electronically via Bancontact, iDEAL, Mastercard, Visa or Maestro.

5.2 Credit card

When paying by credit card, the amount will be debited upon shipment.

6. Delivery

6.1 Term

Delivery usually takes place within 7 business days of receipt of payment. Delays do not entitle you to compensation.

6.2 External carriers

TSR works with external carriers who operate according to their own delivery schedules. Any delays are not attributable to TSR.

6.3 Absence upon delivery

If the customer is not present, the carrier's procedure applies.

6.4 Failure to collect

Uncollected deliveries will be returned. The customer will pay 30% of the total purchase price. The remaining amount will be refunded.

6.5 Non-deliverable goods

In the case of undeliverable goods, TSR may terminate the agreement and refund or resend the goods at its own expense, without compensation.

6.6 Subsequent sending

TSR will inform the customer as soon as possible. The customer may refuse subsequent shipment.

7. Liability

7.1 Information

TSR strives to ensure the information is accurate, but errors may occur. TSR is only obligated to provide reasonable commitments.

7.2 Availability

Products are available while supplies last and the offer may be modified or withdrawn.

7.3 Damage

TSR is not liable for consequential damages. Compensation is limited to the purchase price. Resale of purchased goods is prohibited. Violations will result in a fine of €750 per infringement.

8. Right of withdrawal

8.1 Term

The customer can revoke the agreement within 14 days without giving any reason.

8.2 Procedure

Cancellation can be made by mail ( P.O. Box 258, 7772 PB Hardenberg ) or email ( info@mrhenrys.eu ). TSR will send you an acknowledgement of receipt.

8.3 Exception

Revocation is not possible for sealed goods whose seal has been broken after delivery.

8.4 Refund

Payments (excl. delivery costs) will be refunded within 14 days, unless otherwise stated in 8.8.

8.5 Payment method

Refunds will be made via the same payment method, unless otherwise agreed.

8.6 Returns

Goods must be returned unopened to Gramsbergerweg 66, 7772 PB Hardenberg within 14 days.

8.7 Costs

Return costs are the responsibility of the customer.

8.8 Suspension

TSR may withhold reimbursement until the goods have been received or proof of shipment has been provided.

8.9 Depreciation

The customer is liable for any diminished value resulting from use that goes beyond what is necessary for inspection.

9. Force Majeure

In the event of force majeure (e.g., war, fire, logistical problems), TSR is not liable. Obligations are suspended for the duration of the force majeure.

10. Product information

10.1 Accuracy

TSR strives to provide accurate product information, but this is an obligation of means.

10.2 Labels

In case of deviations, the information on the product label applies.

10.3 Control

The customer must check the product information before consumption and waives any claims upon consumption.

11. Complaints

11.1 Visible defects

These must be reported immediately upon delivery on the delivery note.

11.2 Other complaints

Complaints must be reported within 14 days of receipt via the contact form or info@mrhenrys.eu .

12. Applicable law

12.1 Choice of law

All agreements are exclusively governed by Dutch law.

12.2 Competent court

All disputes fall under the jurisdiction of the Overijssel District Court, Almelo location .
